NEWS :: Capital Tax Partners Send Memo to IRS
May 14, 2007
On May 14, 2007 Capital Tax Partners sent an official memo to the IRS on behalf of the
Federation of Exchange Accomodators (FEA) providing comments with respect to questions
posed in Revised Initial Regulatory Flexibility Analysis with respect to the Proposed
Regulations under Sections 468B and 7872 of the Internal Revenue Code.
The letter was 8 pages long, and included two Exhibits A & B.
Exhibit A was 5 pages of testimony by 1031 Exchange Coordinators and was entitled "A
White Paper Presenting Several Banking, Accounting, and System Consequences of the
Proposed Regulation 468B on Small Qualified Intromediaries (QIs) Updated with New
Observations through May of 2007."
In an e-mail to all exchange facilitators nation wide, Joe Mikrut stated, "Thanks to
everyone for your insightful comments and quick turnaround.
Special thanks to Suzanne and Richard [Dance] for their hard work on the interest
rates and compliance costs, respectively. We will follow up with the government
recipients after they have had an opportunity to review the documents and keep you
posted on developments."

NEWS :: Richard Dance Speaks in Washington D.C. at the TICA Educational
Conference

Richard spoke to 598 members and nonmembers who attended the One-Day Educational
Conference and TICA Spring Symposium in Washington, D.C. He spoke on the panel
addressing the issue: "Why Tenant-in-Common Investments are a Viable Rational
Investment Strategy for Investors."

NEWS :: Richard Dance Speaks at M5
December 6th, 2006
Richard spoke to a 275-person crowd at the M5 (Five Million Net Worth)
conference in Las Vegas, NV. He was the second speaker in the 5-day
conference and followed Rulon Gardner - the Olympic Gold Medalist Roman-Greco
Wrestler. Richard spoke on "12 Beneficial Insights for Greater Understanding
of 1031 Like-Kind Exchanges."

On December 5, 2006 at the WMS Financial Planners Annual Appreciation Dinner,
Alan and Richard Dance honored William M. Swayne II by re-enacting the TICA
American Champion in Excellence Award that Bill won earlier in October.

Entitled "The #1 Challenge With 1031 Exchanges"

As we look back over the past few years, it is very clear that the #1
challenge with 1031 exchanges is not being able to identify appropriate
replacement property within the 45 day time deadline.
Clients enter into an exchange with the expectation of completing it and
deferring their capital gain taxes, but end up receiving all their exchange
proceeds back on the 46th day with the prospects of paying full taxes for
the year. It is not uncommon to see exchange credits returned of $100,000
to $10 million dollars due to not meeting this requirement.
(A) What identification deadline did they miss? (B) What does identification
mean? (C) What caused the difficulty? (D) What can you control? (E) What
can't you control? (F) What can you do about this? These are the 6 questions
we'd like to respond to in this article with special emphasis on the last
one.
